Terms of Service

1. Agreement

By downloading, installing, or using GymDawg AI ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a binding agreement between you and GymDawg AI Ltd, based in Abbotsford, British Columbia, Canada.

2. Age requirement

You must be at least 13 years old to create an account and use GymDawg AI. If you are between 13 and 18 years old, you confirm that you have your parent or guardian's permission to use the App.

We do not knowingly collect or solicit personal information from anyone under 13. If we learn that a user under 13 has created an account, we will terminate it and delete the associated data.

3. Subscription plans

GymDawg AI offers a free starter tier and one paid subscription plan, billed monthly through the Apple App Store or Google Play Store:

• Free: first 3 workout sessions at no charge and no credit card required
• Pro Dawg — $17.99 CAD/month: full AI camera, voice coaching, recovery AI, Dawg Chat, nutrition logging, voice command logging, advanced analytics, and streak rewards — every feature is included, there are no separate tiers

New users receive a 7-day free Pro Dawg trial on sign-up. At the end of the trial period, you will be charged for the plan unless you cancel before the trial ends. Pricing is in CAD and subject to change with advance notice.

4. Billing and renewal

Subscriptions are billed monthly in advance through your App Store or Google Play account. Billing occurs on the same date each month (or the next available date if your billing date does not exist in a given month). Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period.

All payments are processed by Apple or Google. GymDawg AI does not store your payment card details. Any billing disputes must be directed to Apple or Google in accordance with their purchase terms.

5. Cancellation policy

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date.

To cancel on iOS: Open Settings → tap your Apple ID → Subscriptions → GymDawg AI → Cancel Subscription.

To cancel on Android: Open Google Play Store → tap your profile icon → Payments and subscriptions → Subscriptions → GymDawg AI → Cancel.

Deleting the app does not cancel your subscription. You must cancel through your App Store or Google Play account settings.

6. Refunds

Refunds for App Store purchases are handled by Apple; refunds for Google Play purchases are handled by Google, in accordance with their respective refund policies. GymDawg AI does not issue refunds directly. If you believe you are entitled to a refund, contact Apple or Google support.

Trial periods are provided free of charge. If you forget to cancel before a trial ends and are charged, you may request a refund through your platform's standard refund process.

7. Your account

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You may not share your account or subscription with others
• Notify GymDawg AI Ltd immediately at support@gymdawgai.com if you suspect unauthorized access to your account

You can delete your account and all associated data at any time from Tune Your Dawg → Delete Account within the App, or by emailing us. Account deletion is permanent and cannot be undone.

8. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse engineer, decompile, or extract the App's source code
• Use automated scripts, bots, or scrapers against the App or its services
• Share, resell, or sublicense access to the App or its AI coaching features
• Attempt to circumvent subscription gating or access features beyond your plan
• Upload or transmit content that is illegal, harmful, or violates the rights of others

9. Health and fitness disclaimer

Consult a qualified healthcare professional before starting any new exercise program, especially if you have a pre-existing medical condition, injury, or health concern. Stop exercising and seek medical attention immediately if you experience chest pain, severe shortness of breath, dizziness, or any symptom that concerns you.

GymDawg AI is not responsible for any injury, health complication, or other adverse outcome that results from following suggestions made in the App.

10. Intellectual property

GymDawg AI and all related content, branding, designs, and software are owned by or licensed to GymDawg AI Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial fitness tracking purposes.

You retain ownership of any content you create and store in the App (workout logs, photos, notes). By using the App, you grant us a limited licence to store and process that content solely to provide the service to you.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the App in a way that harms other users or the service. If your account is terminated for cause, no refund will be issued for any remaining subscription period.

You may terminate your account at any time as described in Section 7.

12. Limitation of liability

To the maximum extent permitted by applicable law, GymDawg AI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia, Canada.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you in-app or by email at least 14 days before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
